IMPORTANT MEASURES WHILE STAYING IN THE HOME FOR RENTAL CONTRACT
There can be different types of doubts which can arise in the mind of tenants while terminating their rental housing contract. The amendments in the urban leasing law of 4/2013, of 3rd June, this will apply to contracts which are concluded from 6th June 2013 to the current period, this means that tenant has a compulsory duration of stay in the house, which is a minimum of six months.
How do i know the minimum compulsory stay for my rental contract?
The minimum stay which is compulsory for the tenant to stay in the house is six months from the date of the agreement. However, during this period, the tenant is obliged to keep the contract active and just need to pay the rental dues during this stay which is of six months.
From when the compulsory stay is calculated?
It is simple to calculate the compulsory stay, just calculate from starting of the lease, when the lease is started? Usually, it starts when the contract is signed between both parties.
What will happen if the tenant needs to leave the house before the compulsory stay which is of 6 months?
This will lead to contractual breaking. In such a case if the owner does not agree on conditions, the tenant has to do the following things:
- The consent with the demanded term is that, pay the rent while staying in the home
- If the tenant does not want to live in the house, he/she can pay the rest of the contractual rent which is remaining, until it reached the mandatory six months.
If the tenants want to leave the house after completing the compulsory period of six months
If the six months of stay which is compulsory is over, now the law allows the tenants that he/she can end the contract. However, tenants need to contact the landlord minimum of thirty days before. For more clarity, the communication for terminating the contract must be done in written format. If there is any compensation on which both parties were expressly agreed in the contract, the tenant must compensate it, with the rules and regulations provided by the law.
